I dont think this one has any grounds to sue ANYONE! She was in a public place with no expectation of privacy. I doubt there is any 'standard of care" the security folks at the mall have towards her. If she hadnt opened HER big mouth and told everyone it was her no one, or very few people, would have known it was her. I'll also bet the fact the fountain had no guard rail is per code in the state of PA. Best of all she works there?

 

I LMAO when I saw this and had I been working security there I'd have walked her over to something like bed bath and beyond and gotten her a nice fluffy towel.

Best part she admitted laughing at it when she first saw the film and thought it was funny. THEN, the bucks started floating around in her mind to scheme up a way ta make money out of it. "No one came to my aid to see if I was hurt". That's what she'll get em on. 80% her fault, 20% malls fault. Ten Million settlement, so she gets 2 million which 1.8 mill will go to the attorney. Easy job fer any attorney. America, ain't it great :FlagAm:

Actually, no. We hear about all these personal injury cases with big payouts (i.e. the hot McDonalds coffee) but the truth is very few of these cases win.

That was the most pathetic interview I believe I've seen in a long while. Any of us could trip and fall into a fountain and I doubt that any of us would show up on GMA. She hopped out of that fountain like a wet cat, there wasn't anything wrong with her. And she's crying like something terrible had just befallen her and mall security didn't come rushing to her aid. She didn't need mall security, she needed a life guard.

What is even worse is that she was in court today on charges against her. She is not only dumb but her attorney is a bigger schmuck for taking her case. She won't get a dime. I'd be too embarrassed to put my face out on TV for doing something this dumb. When are people going to take responsibility for their own actions? She should have gotten a copy and put it on funniest videos. Dumb @ss.

I practice law fer a livin'.....that's prolly why I dislike lawyers. :blush:

 

Earlier post is on track....it's not a personal injury case cuz she's not hurt. "Nobody came to my aid" is ridiculous since she appeared to be unhurt. So, it's about the embarassment of the video being released. Without getting into to too much legalese, I don't see her getting much out of this. If I represented the mall, I'd advise my client to tell 'em to "pound sand."

 

I agree with an earlier post -- put it on America's Funniest Home Videos and win $10k. :D
