Roy Otriz was saved from a flood in Colorado back in September during their historic floods, but now he’s saying that first responders didn’t act quick enough so he’s filed papers notifying them of his intent to sue. Ortiz claims that rescue crews didn’t realize that he was trapped in his vehicle, which was upside down, in the early hours of September 12. He claims to have been yelling but never got a response from them. “I started yelling again and I started making noise to let them know, those people, that I’m alive,” Ortiz said. He said that they had failed to help him after he jumped into the back seat of his 2003 Pontiac in an effort to stay alive and had to stay there for two hours until help arrived. Now, six months later, Ortiz wants to sue the very people who saved his life rather than thank them for risking their own to save his, claiming he needs help with his medical bills. The lawsuit documents claim that the road should have been closed prior to his trying to take it to his destination and ignore the fact that he shouldn’t have been out on the road to begin with. Now his attorneys are claiming the suit is to preserve his rights in the case and said that they’re not actually going after the people who helped him. “It’s unfortunate to have to try and cast liability and responsibility for this act of God on the men and women who risked their own lives,” said Ed Ferszt. Even though Ortiz has gone the route of a frivolous lawsuit to try and recoup money for medical bills that have occurred because of his own actions, first responders in the area are still happy they were able to save his life. Sara Farris from North Metro Fire Department said that “I’m sure it was a traumatic experience for him,” then added that “Ultimately, we were just very grateful we were able to save his life that day.” Ortiz’s suit is for $500,000 which he claims as a result of their inaction.

Are all FD supposed to have clairvoyance for acts of GOD ? Aren't we all responsible for our own actions? Oh sorry that is SASS. And all this is an act of God and he wants 500 K from a town fire dept. I have a solution for this POS. All roads are CLOSED to him.

Strawboss, SASS #28759 Posted March 6, 2014 Posted March 6, 2014 As a career firefighter/paramedic for 23 years, it still amazes me what we have to go through and put up with to save dumb people's lives. I have a 1 million dollar liability insurance policy to protect me from idiots like this guy. A good trend I'm seeing though is that many states are starting to charge these idiots who need rescued after being told to not do what they do or drive/climb/hike/jump/raft/swim/walk/dive etc... where they aren't supposed to. Hey folks, news flash for those who may not know it, WE PAY HIS MEDICAL BILLS! Whether by Obamacare if he doesn't have insurance, or, by increased costs to us all because his insurance company pays.

I hope he gets slapped down and he and the legal team have to eat the expense. That is the correct outcome, but it may be more likely that there is an out of court settlement and he and the legal team will make money and further encourage this reckless, immoral legal behavior.
Bad Hand Posted March 6, 2014 Posted March 6, 2014 Way back when, I was a Deputy Sheriff in coastal North Carolina. Hurricanes are a fact of life there and come with several days warning. Regardless of that, some people refuse to evacuate the coast and barrier islands, but every one we had, right at the peak of the storm, some would dial 911 and demand we come save them. What can I say?
Trailrider #896 Posted March 6, 2014 Posted March 6, 2014 What this idiot doesn't seem to realize is that the flooding was so extensive and its severety so unexpected that most of the first responders couldn't even get into some places for days. In some instances it took helos from the Colorado National Guard and the U.S. Army (from Ft. Carson) to transport people out of isolated areas. All of the roads damaged and destroyed during these floods have not been completely repaired yet! I think somebody ought to read this joker his rights: "You have the right to remain silent. So sit down and shut up, and be glad they got to you at all!"
Strawboss, SASS #28759 Posted March 8, 2014 Posted March 8, 2014 That's correct trailrider, that's why evacuation notices are put out and why its so important that folks follow them as if they, meaning those who did not heed the warning, cannot get out, then how in the world are rescuers going to get in? Again, lawyers protect stupid people, in the wild, stupid animals die, its called improving the gene pool. Hopefully this guy hasn't produced offspring yet.
