Why wouldn't it be a legal pocket pistol?

A pocket pistol is a:

small frame, 

fixed sight,

pre-1900 design revolver

having a barrel length of four inches or less.

Pocket pistols must be .31 caliber or larger.

Most Velo dogs are <31 caliber.  This one appears to have a swing out cylinder. 
I have one, folding trigger, unmarked caliber. 32SW won’t fit, I think it is 7mm. Mine does not have swing out cylinder. 
but a neat collectible!

The one in question has a loading gate with a "swing out" ejector rod...not a swing out cylinder.

It is chambered in 7.65mm (.32 caliber).

My velodog has a fold up trigger to make it easier for the bicyclist it was designed for. But mine is in .25ACP. Really neat pistol, but not something I would ever use, A knife might be a more effective weapon, close or far.
