California Gun Laws

Hey There!

 

Being from a state other than The Golden One, I have need of what the current state gun laws entail. So here is the question:

 

If a California resident does a face-to-face purchase (for a pistol) outside of the state, how does he/she LEGALLY get the gun home? As a side question, what is the requirement for Micro-Stamping?

Face-to-Face sales must be between residents of the same state in that state. That is a Federal law. California resident may not purchase a handgun outside of California, so this whole scenario is illegal.

The purchase must be made through an FFL in Ca. Until then buyer must wait the ten day period after the DROS started. There's no other legal way around it. Micro stamping is non existent here. Thank god.

The only way to git it done is: go thru a FFL in the state that you're buying the handgun and have that FFL send it to an FFL in CA where the buyer will pick it up. You can buy handguns from other states, its done all the time in these here Classified. But, FFLs must be involved.

Unless something has been added recently, only 1 FFL is required, and that is the one in CA. In this respect, CA is no different than most states.

 

The complication may arise when the CA FFL refuses to accept from an individual. Then the seller must decide whether to abandon the sale; request that the buyer find a cooperative FFL; or ship through an FFL on his end. An FFL shipping into CA must obtain clearance from the CA DOJ to ship to the buyers FFL prior to shipment.

An individual shipping into CA does not need CA DOJ prior approval.

You may buy long guns out of state in some states but handguns must be bought in state legally. This is a general statement that has many exceptions depending on the purchasers home state the state they were wanting to buy the handgun in and the gun it self. If it is covered by the nfa or not. But I'm not familiar with an instant where the hand gun is covered and the buyer is a non resident where they can buy a handgun out of their home state without having it sent through a in state ie home state ffl.

I am an FFL and what Mack states is dead on. If the seller is a non licensee he will need to ship the gun to a Cal. FFL that accepts guns from an out of state non-licensee seller. Only then, after completing the Cal. requirements can the Cal. buyer take possession.
