Tell us again how it won't lead to confiscation...

It was only a mater of time, this is a prime example of a blurred line in the sand, what exactly is the definition of being dangerous?

Which is exactly why so many of the anti-civil rights laws are written so vaguely. With very little effort almost any non-single shot firearm can magiacally become an "assault weapon" and almost any mental state can become "dangerous."

 

One of the standard questions, "Have you EVER had suicidal thoughts?" can truthfully be answered "Yes" by almost everyone. I know very few people who, at some point in their teen, hasn't had the thought "I'd be better off dead." But answer truthfully with that in mind, and PRESTO! you become "a suicide risk."

I'd be surprised if eveyone else doesn't have something similiar written into their state laws.

Police are required to go before a judge and present evidence of probable cause to get a warrant to seize the guns after which a judge is required by law to hold a hearing with 14 days.

 

I'm guessing he said something to one or more shrinks that set off warning bells.

The guy is a vet - strike one. He was hitting the sauce - strike two. Went into detox - strike three. Admitted to being depressed while in detox - strike four. There are pshrinks who will say that any one of those is enough to qualify a person as a suicide risk.

We don't know what else he said while in detox. The point is that this isn't some first step toward widespread confiscation, but someone with some mental health issues sufficently alarming one or more shrinks to the point a judge was willing to issue a warrant.

It may not be but, on the other hand, given how vague the wording is, it quite well could be. Here in CA we have had a few cases of people having firearms taken from them because they, or their spouse, changed depression medicines. And one where the guys wife had some sort of mild episode because she forgot to take her meds, checked herself in for an overnight observation, and was fine and released the next day. Still got a visit and the guns confiscated. I think that one was in Bakersfield.

 

I'm always going to give the benefit of the doubt to the citizen rather than the State.

The wording is vague because it is against the law under HIPAA privacy rules for the police, judge or medical people to release patient info, so we only get one side of the story. The benefit of the doubt should go to the citizen, but when the only source seems to be someone using the story to push their own agenda*, I tend to reserve judgement until I have more information.

 

99% of news & blogs are pushing an agenda of some sort.

You that warning you hear on the Viagra commercials about "having an erection lasting more then 4 hours, seek medical help" Well all they need to say is "have an erection lasting more then 4 hours, just look at this "thing" holding the rifle". Damn!

The sad part about this is heavy handed crap like this that takes away the rights of people who pose no threat because of mild issues will lead to bigger problems. because people who could do well with some simple counseling will not seek help because of the risk to their rights when they are not a threat, can lead to bigger problems down the road. More over handed government intervention to try to "save" us...ugh
