Sinto Ave. apartment. Fagananswered a 10:15 p.m. knock on their front door Thursday, Oct. 24. Afriend having just left their apartment, he assumed the friend had comeback. Instead, John Michael Taylor, a felon who showed them his anklebracelet tracker in an attempt to intimidate them, faced him. Taylorasked Fagan for money, and became agitated when Fagan turned him down. Whenhe sensed Taylor might enter the apartment, Fagan yelled for McIntosh, who brandished his pistol, for which he has a concealed weapons permit.Taylor quickly fled. Little did they know, removing Taylor from theirdoorway would lead to potential university sanctions. Fagan, 21,and McIntosh, 23, rent their two-bedroom off-campus apartment, No. 5,from owner Gonzaga University. Complications arose after the men calledboth the Spokane Police and CAMPO to report the trespasser, in doing sodeclaring the pistol to SPD Officer Adam Valdez. SPD quickly apprehendedthe suspect, who was arrested on outstanding felony warrants. Valdezcongratulated the students for safely warding off a possibly dangerousmenace. Link to comment
Forty Rod SASS 3935
Cousin John just can't stay out of trouble. He should thank the kid for not scattering his vastly under-used brain all over the walls. Link to comment
Tell Sackett SASS 18436
If they lived off campus, what trouble could they be in? The university can tell them what to do off campus??? Oh, I see now. The UNIVERSITY owned the apartment. Figures. Link to comment
Virgil Ray Hality, SASS# 37355
I suppose, one has to look at the lease to see what is written in it. Then again, as far as the actual university goes, I suspect it depends upon how/what the university properly conveyed to the students about university policy regarding student behavior related to firearms and attendance. With my son now in colledge some of the things you see in a lease or in the colledge terms & conditions are not very specific in this regard. Link to comment
Oklahoma Dee
Washington STATE CONSTITUTIONAL PROVISION The right of the individual citizen to bear arms in defense of himself, or the state, shall not be impaired, but nothing in this section shall be construed as authorizing individuals or corporations to organize, maintain or employ an armed body of men. I am not sure where a state provision applies, in a case like this, but hope that they come out well. OkD Link to comment

This, after two students who used a pistol to chase an intruder fromtheir apartment door found themselves on probation for having guns -- inviolation of a ban on firearms in university-owned housing. The school's president says Gonzaga is "a Jesuit institutiondedicated to thoughtful evaluation of complex social issues," and thatit will use the incident to re-examine its policy on guns. A lawyer for students Erik Fagan and Daniel McIntosh says the school should consider student safety above all else. Link to comment
