Mrs. Kunishige asked, what are liberty minded people doing about this constant infringement of their Constitutional rights? I responded that many people are protesting, writing newspapers, many people are choosing to eat somewhere else. Tina indicated all of this was good, but it was not enough. She suggested that for liberty to win supporters of the Constitution had to demand their Constitutional rights. And that is what Tina did. She took personal responsibility for Liberty. She let the local and regional manager of Buffalo Wild Wings whose name is Jay Dowed and who appears to be located in Lacey, Washington know, she was going to sue their store. You see, in Idaho Tina questions the legality of business owners, which serve the general public, the right to deny anyone their Idaho State constitutional rights. Some people believe that it is a business owner right to pick and choose which state Constitutional rights it will honor. An example Tina and I discussed is; would it be legal for a restaurant owned by an Atheist to say you could not pray before your meal? Why is it legal for a business, which serves the public to deny people their state or federal Constitutional rights because they don’t like this or that right? In this example, the right to keep (own) and bear (carry) arms. Idaho State constitution guarantees that all citizens can open carry firearms. An interesting point that Tina found is that Idaho may have more protections against businesses restricting Idaho State Constitutional rights.

Idaho State Constitutions Section 11. Right to keep and bear arms. The people have the right to keep and bear arms, which right shall not be abridged; but this provision shall not prevent the passage of laws to govern the carrying of weapons concealed on the person nor prevent passage of legislation providing minimum sentences for crimes committed while in possession of a firearm, nor prevent the passage of legislation providing penalties for the possession of firearms by a convicted felon, nor prevent the passage of any legislation punishing the use of a firearm. No law shall impose licensure, registration or special taxation on the ownership or possession of firearms or ammunition. Nor shall any law permit the confiscation of firearms, except those actually used in the commission of a felony.”

You see Idaho has very strong laws defending the Constitutional rights of all of its citizens specifically against businesses abridging them. For example Idaho Code Title 30, Chapter 5 (30-501) “Every corporation organized for any lawful purpose or purposes, whether a general business corporation or a designated class of corporation, shall, by the act of filing incorporation documents with the state of Idaho, acknowledge and accept the provisions of the constitution of the state of Idaho as binding upon that corporation.” The people of Idaho have spoken. If you want to do business in Idaho, you will respect Idahoans.
