Krazy Kajun
This is an excerpt from the article online... "The ruling by the Appellate Division of the state Supreme Court reversed a lower court's 2011 dismissal of victim Daniel Williams' complaint, which accused Ohio gun maker Hi-Point and distributor MKS Supply Inc. of Ohio of intentionally supplying handguns to irresponsible dealers because they profited from sales to the criminal gun market. The appellate panel said the Buffalo man's lawsuit should have been allowed to move forward because Williams' claims fall within exceptions contained in the Protection of Lawful Commerce in Arms Act, a 2005 federal law shielding gun makers from lawsuits over criminal use of their products." Hacker, SASS #55963
This case sounds like the FFL didn't do his job. The article does not say if the multiple handgun purchase paperwork was filed or not. Complaint sounds like lots of handguns at same time. Straw purchase perhaps But I don't see how the manufacturer is responsible for what the FFL does. In any event since Federal Law is involved it is most likely headed to the Federal Appellate court system.
Ugly, SASS #18106
It would only make sense if every auto manufacturer, baseball bat, golf club, knife, fork and spoon manufacturer, ad nauseum were held responsible for some idiot misusing their products. The OP didn't say whether the "victim" was shot, or beat over the head with it. eGG
