Nebraska LB390 Passed

One good piece of legislation passed this time around. Right at the end of the LB390, which takes away the governor's right to limit the sale, possession, or transport of firearms during a declared state of emergency, passed unanimously. Unfortunately, since it passed at the end of the session, if the governor vetoes it there is no time for an override if the governor vetoes it. He is expected to sign it though, but any contacts you could make to his office would be appreciated.

 

From the NRA-ILA:

"in the final hour of its 2014 legislative session, the Nebraska Legislature unanimously passed critical emergency powers legislation in its Final Reading. Legislative Bill 390, introduced by state Senator Mark Christensen (44), now goes to Governor Dave Heineman ® for his expected signature.

The amended version of LB 390 will strike the word “firearms” from the list of items the Governor may suspend during a declared state of emergency. LB 390 protects Second Amendment rights by ensuring that a Governor does not have the power to prohibit or restrict the otherwise lawful possession, use, carrying, transfer, transportation, storage or display of a firearm.

 

LB 390 also contains language from Senator Les Seiler‘s (33) bill, Legislative Bill 694, which was added as Amendment 2710 two weeks ago during the General File reading. LB 390 will allow an otherwise lawfully possessed firearm to be possessed by a person on school grounds for the purposes of a historical reenactment or hunter education program, with approval from the school.

Great news! The governor signed LB390 into law today! Thank you to anyone that contacted the governor's office on our behalf

 

With this law, during a state of emergency, the governor is forbidden from the following actions:

1. Controlling access to, transport of, or transfers of firearms

2. Banning the purchase of firewarms

3. Controlling access to ammunition of any type legal before the state of emergency

4. Confiscating any firearms
