DOJ: Young Adults Have Full 2A Rights

In a 49 page opinion, the DOJ Office of Legal Council recognizes young adults are part of The People and have full rights including recognition under the 2nd.

Adults between 18 and 20 are members of “the people.” Handguns are protected “arms” and remain the most commonly selected firearms for personal defense. The right to keep and bear arms also necessarily includes the ability to acquire one. Congress cannot avoid the Second Amendment by criminalizing the seller instead of the buyer.

 

Nor is access to private transfers or gifts an adequate substitute for being allowed to purchase from an FFL. Not every young adult has a relative willing to provide a handgun, and several states restrict private transfers. A constitutional right cannot depend on finding someone else willing and legally able to exercise it on your behalf.

 

The OLC’s conclusion tracks the Fifth Circuit’s ruling in Reese v. ATF. The Fifth Circuit likewise held that 18-to-20-year-olds are among “the people” and that the government failed to identify a comparable Founding-era restriction.

The public safety provision has been in place since 1968 and was a key strategy to preventing juvenile crime and violence.

They miss the point of the opinion, the opinion applies to adults who are fully responsible for their own actions.

We must remember that Brady Bunch perception is that if you’re gun friendly, you’re juvenile!! The Goofords and Mad Mommies have the same opinion!!

 

They come at all of us like we’re children that they can wag their finger at us and tell us “NO” and expect us to quietly acquiesce!!

 

It would be marvelous to see these people, (politicians, organizations, and private individuals alike) and their financiers driven into bankruptcy from having to pay fines, penalties, and the legal fees of the people that they seek to suppress!!

This is why it is incumbent on all of us to get out and support and vote to keep the people who have brought us to this point in positions where they can continue to push this agenda forward and find other ways to improve the justice system and honor and support our Constitution!
