Adamiak Pardoned!

Not only should he have received the pardon, (long overdue and should never have been necessary) but he should be reinstated to his former rank, have the conviction expunged, and receive back pay for the entire time he was held!!

That would be good!

Also pardoned are George Peterson, Jeremy Kettler, and Shane Cox.

A question arises from this that should be answered quickly.

What effect will this pardon have on the case before SCOTUS??  Will that case be mooted or should it go forward. If it’s allowed to go forward it would establish new and potentially powerful precedent for future cases and make the kind of gymnastics used against Adamiak legally prohibited.

Adamiak's petition to the Supreme Court was denied last term. His pardon has no impact on any current case.

JK!! Are all of these others also 2A related??

Answering my own question! Yes!! All were 2A cases that were apparently overzealously prosecuted by ATF or related agencies.

Can the officials who persecuted him be charged with malicious prosecution?

Persecuted is a good choice of word in Adamiaks case, every single thing he had was legal for you and I to own. Qualified immunity is still difficult to overcome. He should at least have civil claims for back pay. I hope he does.

On qualified immunity. From: (with my bold):

https://ij.org/report/unaccountable/the-controversy-over-qualified-immunity/

"

In the four decades since its creation, qualified immunity has barred lawsuits against federal, state, and local government officials unless plaintiffs can show that officials violated a clearly established constitutional right. And in practice the bar for being clearly established can be high.

They definitely violated his rights. They likely misused the Second Amendment if they didn’t violate it and perhaps the Fourth as well!

It could also be claimed that Jeffrey Bodell perjured himself, which denied Adamiak the right to a fair trial!! Both Bodell and BATFE could possibly be held liable, as Bodell acted as an agent of the bureaucracy in his phonied up investigation and his testimony.

There are individuals within the BATFE who have been guilty of malicious conduct and malfeasance. Their overreach and fabricated evidence should be rewarded with prosecution and prison time!!

Really would have liked to hear him speak at NRGC. A discussion between William Kirk and Tate Adamiak:

Back pay, four years retroactive time in service added to his prior service time, two grade promotion to Senior Chief, and full 20 year retirement four years early.

Sure hope he gets all the above.  It's the very least the government can do to help set right a severe miscarriage of justice.

Not sure he will get all of that. I did note when he was first arrested and charged, the military continued his pay under accumulated time off. When all of those resources ran out, the military issued him an honorable discharge.

Should he wish to return to military service, there does not seem to be any hurdle he needs to clear.
