There are states with no restrictions and states with suppressor bans. In the middle are a few states which require federal registration for lawful possession.

 

There is now a big messy hole in the laws applying to the covered devices.

 

Next events on these questions will be decisions in Roberts (6th) and Brown (8th), and ATF/DOJ guidance. All three in no particular order.

 

Until at least then, consult a lawyer before skipping a Form 4 when buying or selling a can, or Form 1 before making any covered arm.

The Palmetto State Armory (plaintiff in the suit) South Carolina store will transfer a silencer to a state resident. PSA does advise consulting an attorney. PSA also advises there may be future problems for transfers, it applies only to individuals (not trusts), inheritance and travel across state lines may also have issues. And more. Also does not apply to the North Carolina or any other store due to state laws, no to residents of any other state.

 

On a separate topic in the link, Those who previously purchased a rifle or pistol from Palmetto in the past and are current GOA members may be able to legally convert them into an SBR without paperwork, assuming state law allows it. Many of the above future transfer and travel concerns apply. And again, Palmetto suggests consulting one's own qualified attorney.

 

Palmetto also warns against no clarity for what happens if the ruling is stayed, appealed, over-ruled later, or other events. To be clear: "All sales are final and are made without any warranty as to legal status. PSA cannot and does not give legal advice. ..."

I'm not sure the first press release is authentic. I could not find it on the silencerco site. I skimmed it and it looks like a summary of the link to Silencerco. 

 

The second one from Silencerco is the clearest guidance I have seen yet.

 

Still. until after October 5th and after the DOJ/ATF speaks, I am not going to get what might become a "Freedom Month" silencer.
