On August 5, 2026, in our lawsuit Silencer Shop Foundation v. ATF, a federal court ordered the ATF to stop enforcing NFA registration against Silencer Shop customers. No Form 4. No federal registry entry. No waiting on the government to bless a purchase you already paid for. You buy your suppressor, pass the same background check you'd pass for a rifle, and take it home that day.

And to be clear about what the real news is: Congress already made the tax stamp free back in January. That was never the hard part. The hard part was the registration, and the registration is what just fell. This is the biggest hit the NFA has taken since it was written in 1934 — and Silencer Shop Foundation is the one that landed it.

See the thread in Team Sass. I just posted my analysis there.

 

At minimum a week to see if the fed appeals. Could be 6 months to a year to still reach final resolution but a week would be nice. Especially if you are a member of a named plaintiff organization, at least in the 5th circuit.

 

I both agree with the ruling and recognize its limits.

As a member of the GOA, it is supposed to apply to me. I guess I'll see what happens. I would like a suppressor for my Ruger 10-22.

Sir, this is a separate ruling not by GOA this is where Silencer Central sued  in addition to the GOA strictly for Silencer Central customers 

 

The Court issued a 7-day stay, so these changes are currently set to take effect by August 12, 2026, assuming the stay is not extended. We'll keep this page current so you always know where things stand

 

Well real curious as in addition to this SD deregulated Suppressors entirely effective July 1 for any SD made /sold suppressor  

 

 

All sounds good just have to wait and see what happens you know Big Daddy ATF would not just walk away.

Actually, the ruling covers two separate suits that were joined, (combined) by the court.  It DOES spread the coverage to the plaintiffs and their assigns of both actions.

 

Maybe, if we’re lucky, DOJ and BATFE will simply choose not to contest the ruling at this time and it can percolate into a nationwide coverage when it finally reaches SCOTUS.

 

That may require another circuit like the ninth to rule differently, which would then create a conflict that required a ruling by the Supreme Court.

Built one after the tax stamp went away  42 days on the Form 1  nothing super fancy just good parts  10.5 barrel 5.56 Spikes lower with FRS and Huxwrx can (should have went a lighter barrel and still might 

  You will not be disappointed with Suppressor about 112 decibels 

 

So if this stands expect me to be building a 300 Blackout SBR

Glad for the win and I suspect DOJ won't appeal.  I do think there a lot of states that will pass laws either banning silencers all together or heavily regulate them.

 

Currently in Connecticut it's "a pistol with a threaded barrel is usually not legal if it is semiautomatic and takes a detachable magazine" and sellers won't ship to CT.

 

Centerfire Semi-auto rifles with detachable magazines cannot have a threaded barrel unless it was registered prior to the AWB in 2013

If SBR’s are suddenly unregulated by the atf, what happens when it’s an sbr, not a pistol?   I expect that these hardware bans will go down next year once the Supreme Court rules on the awb bans.

SBR's have never been Illegal i have 3

Correct! They have been taxed, (until the BBB passed congress last year) and for the moment, they’re required to be registered!

 

Depending on how the DOJ and BATFE react to the stay and further appeals, folks involved in the suits and perhaps the entire jurisdiction of the fifth circuit may not have to register them.

Can't say I needed it, but $200 less cost is a good start. Since the ATF already knows about me from other stamps I did get this recently:

Parts for the next five modifications are in transit. Will be nice in the future to just do a 4473, feel like a dream as far as ever finding them at WalMart in blister packs.

From what I read you do not have to be a member of any organization for this to pertain to you. It does appear this is for Silencer Shop customers, but it should cover anyone once the case is settled. The government can’t show favoritism unless you’re very rich and have connections… Oops,  I mean this would be for everyone. Right?

this is a step in the right direction but its a lower court we know it will be appealed , we need a supreme ruling if we can get it

These efforts and the ones they exhibited earlier in the BBB are exactly why - no matter what the final outcome is - "I" will never patronize Silencer Shop with a dime of my money.

Only at the Federal level for now, state laws still apply

A law repugnant to the constitution is void.

 

If its deemed unconstitutional at the Federal level the state laws are moot. It's what we're hoping for in the assault weapons bans right.

i agree that neither custer nor i have a real "need" but id like one on my P322 , i dont need them for anything else nor at this point want them , but if i can i may because i currently have a source i like and trust i may not have when i need it
