This sort of thing is a damned shame!! The state and federal governments are responsible for this failure and NOBODY ELSE!!

 

The courts that allow and condone this crap should be censured and the judges should be dismissed!!

 

Further, any of these suits where the defendant prevails should result in punitive damages being awarded to the defendant in the amount equal to the plaintiffs’ demands plus all court and attorneys’ fees!!

Agree. A judge should have looked at the suit,  said "The store did nothing wrong. This is dismissed with prejudice." 

 

My big question is what is the NRA doing to help, other than maybe filing a weak brief?  It should be providing a team of lawyers to fight this BS.

I’d look toward SAF or GOA for assistance here.  NRA doesn’t usually go too deep into individual cases like this. Most of these cases are in local civil courts and until it reaches federal appeals level, where more Constitutional questions are raised, it’s like playing “Whack A Mole” on a nationwide scale.

In this case, the claim is a violation of state law by the selling FFL led to the shooter taking the rifle to a gun free zone and shooting up a parade.. This is under the PLCAA Predicate exception (one of 6 exceptions):

Predicate Exception: Lawsuits where an industry member knowingly violated a state or federal statute that specifically applies to the sale or marketing of the firearm, and that violation directly caused the injury.

The purchaser lived in Highland Park, and there is a local AWB in that town. The claim is therefore the FFL should have known the purchase was illegal for the buyer to complete, thus aiding and abetting the later illegal act. The ATF did not find the sale a violation of law, Illinois did not find the sale a violation of law.
