Technically speaking, we did not actually have a national government until it was created in November 1777 when the "Articles of Confederation" were adopted. The Articles refer to themself as, "Articles of Confederation and perpetual Union between the States of..." and then it lists the original 13 states. To also quote the document. Article I. The Stile of this confederacy shall be, “The United States of America.” So at that point, the nation existed in an unbreakable "Union." and it was a "Confederacy." To also quote the document... Article XIII. Every State shall abide by the determinations of the united states, in congress assembled, on all questions which by this confederation are submitted to them. And the Articles of this confederation shall be inviolably observed by every state, and the union shall be perpetual; nor shall any alteration at any time hereafter be made in any of them, unless such alteration be agreed to in a congress of the united states, and be afterwards con-firmed by the legislatures of every state. Again, the Union is said to be perpetual, it can not be dissolved. Now, the Flag was adopted on June 14, 1777, BEFORE the enactment of the Articles of Confederation. It was simply an act of the Second Continental Congress. BUT, since the 2nd stayed in session until well after the document was in force, you can indeed assert that it was the flag of the Confederacy. Sort of. By the way, when the Constitution was adopted in 1789, it did create a new government, but not a new nation, or a new Union. Rather, it made the already existing union, "more perfect." And finally, Article VI of the Constitution says... All Debts contracted and Engagements entered into, before the Adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation. It has been interpreted that, among other things, the Union created in the Declaration and defined in the Articles is a prior Engagement, under the Confederation, and as such the Union is still perpetual and can not be dissolved. I still remember being delighted when I learned the origins of the "more perfect union" phrase a very few short years ago . Without understanding the union origin in the original Articles of Confederation, the phrase just sort of hung there for most of my life as nothing but flowery speech. In nearly EVERY unbiased examination of the facts surrounding the secession of the southern states, it’s been acknowledged that they were actually within their legal rights to choose to leave the union. Some of the reasons for the decision to leave were less than honorable in some people’s eyes, but they had every right to make the choice! Confederacies have historically been the first stage of gaining separation from a government that is unacceptable to those who have chosen to leave! THERE IS STRENGTH IN NUMBERS 2 Quote
