If it results in a loss there, then there is a circuit split and the loss has a path to SCOTUS. But if the 5th rules against, the other districts are likely to cite it as precedent and rule the same. This makes the path to SCOTUS harder. The case linked above is not a 2A case. It claims 922(o) exceeds congressional power under commerce clause. Quote
