John Kloehr Posted March 27 Posted March 27 I think the ink on the appeal is already dry. In this case, the state filing stated the law was not constitutional and declined to defend it. Under court rules, the judge appointed amici to provide the defense the state would not provide. I read that filing some time ago, and the justifications really were too late to establish history and tradition. But it seems the judge still bought in to the argument. Probably in great part due to giving credit to the Wolford decision from the 9th circuit. This ruling is from a district judge, not at any appeals level. It is a case under first impression. This is not over yet, now going to the 5th circuit; first likely a 3-judge panel, perhaps the full panel. I do not expect the state to appeal once it does lose, no idea if the appointed amici has that authority or obligation. A good ruling in Wolford from SCOTUS will help. 2 Quote
