time for another legal question

I know that it is illegal for me, as somebody that is older than 21, to buy booze for somebody that is under 21.

 

So if some kid stopped me outside the liquor store and offered me money to buy him some booze and I did it - I broke the law.

 

But if it illegal for the kid to ask me to do it?

 

And if that is illegal, what would the crime be? Conspiracy to buy alcohol by an underage person?

yes , i think that was what they wanted to charge me with - but they really wanted the over 21 year old that bought it for me ...............

i didnt say and they didn't charge , it was sorta a standoff - i won that one and never did any of that again , i always had access at home and i took advantage of that instead of the cornfield parties we did one summer , my parents were very tolerant - the city attorney was a neighbor as was the local sheriff 

 

came back to add that its been near 60 years ago now so statute of limitations has most likely run out - the city attorney and the sheriff are both dead a long time ago as well as both my parents - i dont remember the name or the college kid that bought the booze for me and the friends back then , he was a nice kid and we worked together at an international company that year , he for a year , me for five years , a nice kid that went to the school i started out at

I was just watching a YouTube short - don't know if it was from a TV or a movie. Bunch of high school kids looked like. One of them was on crutches. And he went up and asked the guy outside the liquor store - excuse me sir, I left my ID at home and I was wondering if I could get you to buy me a bottle of whatever.

 

The other guy says, "you know asking that is illegal".

 

The kid said that it wasn't, and the man pulls out his badge and says "yes it is", and all the other kids scamper off into the darkness.

 

And this caused my wonder.

 

It just seemed like - if I sit there and think about how if I rob the liquor store I would have enough money to do something or other. That's just random thinking. But if I get together with a couple of people and talk about robbing the liquor store, that's conspiracy to commit a felony.

 

Still just thinking about it. Not doing anything. But one way is just me fantasizing and the other way is me committing a crime.

 

Laws are strange.

But its not illegal to sit around and figure out all the ways to secure a liquor store against robbery. That's consulting.

Once again, the law is different in every city, county, and state. So the answer to questions such as this will always be "it depends on where you are."

I would think this would be a federal law - like a straw purchase - and so would be the same all over the country.

 

Gun purchases are regulated by the feds. ATF. And booze purchases are regulated by the feds. ATF.

Some states are different. In North Carolina, you can buy beer anywhere, bur hard liquor can only be bought at an ABC store. Don't forget Dry Counties either. There's a store just north of Boston that sits in two Counties, one dry, one not. It has a line on the floor delineating the County Like. You are not allowed to bring alcohol into the Dry side.

Back when I was a LEO there was a Brothel on the state line, half in & half out, painted line on the floor.  After a bit, we coordinated with the other state law enforcement - the patrons & operators were vexed, particularly the Judge who got caught in the raid.
