If word got around that the school district and the employees involved were bankrupted for violating the rights of students, other entities would certainly hesitate to commit the same offense!
John Kloehr Posted October 17, 2025 Posted October 17, 2025 I came across this case this morning, was going to post it up later today and now happy to see @Lawdog Dago Dom beat me to it. I get some grief when I look at the details of a case and then say bad facts make for bad law. A violation of rights is still a violation of rights, but as an example not related to this case, challenging the Felon in Possession law is a tough sell when the felon fired his pistol at a pursuing LE. I had a chance to dig into this one, and look at the underlying facts. This one is clean! All the facts look good. I actually hope the kid does not settle and further hope sovereign immunity does not apply to the school staff or even the school resource officer. This case is the right vehicle for sending a strong message.
