FPC v Bondi (Post Office Carry)

Decided as an as-applied challenge in Texas, favorable ruling for the individual plaintiffs, Members of FPC, and members of SAF.

Given the limited ruling (as-applied, not prima facia) and it being a lower court, I do advise caution for anyone until and unless you are:

  • Within the deciding court jurisdiction
  • A member of one of the named organizations
  • The ruling is not stayed or appealed
  • Or the government agrees all Americans won this round

 

Frankly, I would have been still been a bit happy if just the parking lots were not illegal to enter when armed, fingers crossed this does not get appealed and dragged out further.

An update. The DOJ tried to limit the order to organizational members at the time the suit was filed. Judge say no.

The ruling still only applies in the 5th district, and the DOJ may still proceed in an appeal. But at least in the 5th district for now, signing up as a member of FPC or SAF at least in theory allows carry in post offices. The appeal of the above decision is only a placeholder at this time, the government has not presented an argument as a basis for review. It did file a request to delay proceedings pending Wolford and Hemani rulings.

Start with the 5th for reasonable support in favor of the law abiding citizen, then another ruling elsewhere against. Circuit split --> SCOTUS

I figure the 9th will uphold the unconstitutional law/rule.  Another ruling in favor of the injunction elsewhere would put us over the top!
