Agree clogging the courts does not help and may hurt. I can say for myself the clog of Felon in Possession cases is a pain to deal with. I'm listing them, but most are going down without comment from the judges. I am tempted to just say "23 this week," or whatever the count is. What matters is good cases, those which are developed and which clearly present an issue in conflict with the constitution. With all due respect to those holding any restriction as an abhorrent violation of rights, there are cases like Bruen and cases like, well, the dozens and dozens of Felon in Possession. And for Felon in Possession, the government is finally funding the rights restoration mechanism. I think it should have been funded when it was created. There are many felonies today which were capital crimes at the founding, there are also more crimes which count as felonies today than at the founding. There is an issue, more than one issue. Drugs and guns. Definite issue, there is a history and tradition of disarming those inebriated at the time, in public, with guns returned when sober. Still don;t see traction when conservative judges don't like drugs and liberal judges don;t like guns. Considering the limited resource of SCOTUS judges, I would rather see gun bans struck down than to see felons regain the right to possess whatever musket a state legislature might decide is appropriate for law-abiding citizens to possess. Wolford is also a good choice. Hemani is not IMO, it is going to be another Rahimi unless the supremes get strict about what the government alleges (drug dealer, multiple drugs, ISIS links) versus what he was actually convicted of (habitual user of pot). AWB bans, magazine bans, and get rid of NFA registration on untaxed arms. Those I care about more than all the other stuff. What I think is that if SCOTUS sees a massive influx of 2A cases, even if many of them are basically the same, (and particularly so as well) they will hear the outcry and be moved to take a limited number of these lawsuits and make broader, more impactful rulings in a more timely manner!! Especially where congress and the DOJ have asked for clarification or joined the ranks of citizen plaintiffs, they should be convinced that it’s time to get on with the business of adjudication! 1 Quote

They may get rescheduled as a couple more are on their way to the queue. Still, Duncan is the grandaddy magazine ban case and the best candidate for cert and a decision, the others are more likely to be held and GVRed afterwards. This would include AWB cases. It is looking like everything else from the 12/5 conference is getting bumped to 12/12, which will also have more felon cases. I see no new schedule for any of the 18 to 20 year old purchase/possession cases. Will look again tomorrow or Wednesday to give time for the schedule to settle. Quote

There is a full conference each of the two following Fridays (16th, 23rd) followed by another 3 week break. I'll post the 2A case roster for the 9th on or around January 6th. There are only a few (7) cases scheduled at this time, more will likely be added. There are also a number of cases pending various responses and filings; any of those may also make it in to one the upcoming conferences. This case is still at the preliminary stage which argues against cert (not fully developed) but SCOTUS may find the question so simple as to promote summary judgement in favor of plaintiffs. In simple terms, a statement to the effect that no state law can ban the AR-15 or any so-called AWBs, full stop. John Kloehr Posted February 11 Posted February 11 The next conference is still over a week away, I went through and collected up what I think is a pretty good list of the remaining cases (summary by type below). Some new one came in recently and more are likely in the future. As the arguments calendar fills up, there is a good chance some cases will be held for further review next year. These might include the ban cases and 18-20 cases. Some of the felon-in-possession and drug cases might get GVRed when Hemani is ultimately decided. One of them is actually not Felon, it is a California resident with a possession ban due to having had a non-violent restraining order; this petition is not yet scheduled. Total 2A-related open petitions now total 47. Friday is the first of another group of 3 weekly conferences. This Friday is a short session. I expect them to be held without decision (like the others) until after Hemani, and then GVRed. When Vullo implemented her scheme against the NRA, was it clearly established that the First Amendment did not allow a government official to coerce a disfavored speaker’s service providers to punish or suppress disfavored speech on her behalf? 2. When it is obvious that a government official’s conduct violates the Constitution under longstanding Supreme Court precedent, is the violation clearly established for purposes of qualified immunity despite some factual distinctions that are irrelevant under the governing constitutional rule? These are independent events, each judged separately. There were zero Second Amendment cases from 1939 until Heller was decided. What we need are good cases with good facts that can move the law forward for us, not a flood of desperate attempts to get the Court to listen. Dick Heller won his case because he 1) owned a handgun and 2) wanted to keep his .22 caliber revolver in his home for self defense. It was a simple goal once the right plaintiff was found. An example of the opposite would be the people convicted of domestic violence seeking to overturn the Lautenburg Amendment by judicial ruling. Or the recent ones seeking to overturn the federal prohibition on those subject to domestic violence restraining orders. Those were terrible cases. Good cases are the ones like where the lady wrote a bad check for $400 decades ago and is still prohibited. The moral of the story is we need good cases above all else. 1 Quote

I do think the weapons/magazine ban cases are good cases. Gator's might be a bit manufactured but then looking way back, Rosa Parks was also carefully selected and was a manufactured case. With this hindsight, I will not consider it a criticism, more an acknowledgment. Duncan is now the most litigated ban case in history, there is no possible argument about insufficient briefing or incomplete record. I will not be surprised if none of these cases get certified this term (may get a slot next term per the previous opinion respecting denial of the petitions last term, the calendar is getting full), but it will be shock if any are denied. I do not see better candidates in the pipeline for the future. I'll be looking at orders Monday morning. Edited February 17 by John Kloehr 2 Quote

Another case to keep in mind is an expected decision in Cheeseman v Platkin out of the 3rd circuit (AWB and magazine ban). Could SCOTUS be waiting to see how the 3rd rules before granting cert for one of these? IDK, but I do expect the 3rd to rule soon (arguments were in October). Nearly 2 hours long: https://www.supremecourt.gov/oral_arguments/audio/2025/24-1234 Key takeaway, the Supremes dispensed with all of the other allegations, links to terrorism, cocaine, scales for selling the same, going to a terrorist funeral, his mom, all of it in the first minute.
