Be it defend the Second Amendment or challenge it. Those that opposed her appointment failed to notice that she can separate her personal opinions from the job she is assigned. There are very few state AG's that don't support state laws in court. One was the CA who chose not to support Prop 8 (marriage is only between a male & a female). He didn't bother to hire a 3rd party to defend the state constitutional amendment. Then he fought against the organization that drafted the amendment, gathered the 150 k plus valid signatures and campaigned for its' passage trying to get to defend it in state court which was hostile. Therefore, it didn't get its' day in court. Obergefell ended the issue for now. Should a state or states pass a law that bans same sex marriage to challenge Obergefell like several states starting in DJT's 1st term to test how far SCOTUS will go in green lighting limits on abortion with the current 6-3 majority it is likely that Obergefell could join Roe. Justice Thomas's concurring opinion in Hobbs v. Jacksom Women's Health Organization and the gun ban case review procedure in Heller. Obergefeld is on very shaky ground. Quote
