SAF SUES HAWAII OVER GUN BAN
FOR YOUNG ADULTS, SEEKS INJUNCTION

BELLEVUE, WA – The Second Amendment Foundation (SAF) has filed a federal lawsuitchallenging restrictive gun control laws in Hawaii which discriminate against young adults, prohibiting them from acquiring, purchasing and possessing firearms and ammunition, therefore violating their Second and Fourteenth Amendment rights.

 

The lawsuit, which seeks injunctive relief, was filed in U.S. District Court for the District of Hawaii.

 

SAF is joined by Aloha Strategics LLC, JGB Arms LLC, and two private citizens, Juda Roache and Elijah Pinales. They are represented by attorneys Kevin O’Grady in Honolulu and Alan Beck of San Diego. The case is known as Pinales v. Attorney General for the State of Hawaii.

Good! Hawaii will ultimately rule against, and if it has nothing else to go on, it will rule based on Hawaii's interpretation of the 2nd when Hawaii became a state (thumbing its nose at Heller and Bruen). See previous rulings by this court ignoring the time period for interpreting definition of rights on this basis.

 

Then it will go to the 9th which has not gone quite that far but still, needs to be b***h* slapped by SCOTUS. The 9th will likely also find basis to rule against plaintiffs, probably drawing on excessive dicta in Rahimi.

 

So maybe in 2027 or 2028 this will get settled.

All of this goes to show that we can abrogate our freedom in moments, but, aside from outright rebellion, it takes years to get those freedoms back!!

Rebellion would also take years and cause other problems, it has in the past. Nor is a constitutional convention appropriate when we do not need a new constitution, we just need to go back to applying the old one.

 

Sadly, the years needed to go through the courts, while justice delayed, is still justice served.

 

Had an interesting discussion today regarding the thought of Brandon Herrera being head of the ATF (BATFE). Would it not be nice if the heads of the various agencies actually valued complying with the constitution over trying to get around it?

 

Sort of like our 170 rule in this sport. Don't try to push the 180, just simply stay away from it instead.
