5th Amendment=Jail?

Does look to be a problem with the 5th.

 

Separate problem for the homeowner might be: "The Colt revolver the homeowner used was stolen from Eureka recently."

 

Do hope he can provide information on how it came into his possession. Like the FFL background check required even on private sales in California:

This is a classic catch 22.  The cops have a person holding one person at gunpoint and another has been shot.  Absent statements from all involved parties, arresting everyone was the prudent thing to do.

 

The person holding the gun exercised his 5th Amendment right. However he failed to exercise his 6th amendment right to legal counsel.

 

Without knowing what happened what should the police have done? Released everyone or hold them all until what happened gets sorted out?
