PISTOL BRACE RULE OUT?

As we read this you can bet the demoRats are already scheming how to get around yet another SC ruling in favor of law abiding gun owners. Any court decision that undermines their ultimate goal of complete dominance of the citizens of this country will obviously be ignored and anything that attacks or destroys the plain reading of the Constitution of the United States of America is clearly a good thing in their radical minds. Look forward to more infringements on your Constitutional rights soon!

Sadly, it isn't a nationwide injunction, just for the plaintiffs....and maybe not even for their customers.  Amazing how easy it was to get a district court to give a nationwide injunction for anything the T-man did, but can't get any court to give us a nationwide injunction now.

According to Firearms Policy Coalition’s repeated email statements, they don’t know whether this injunction applies only to the plaintiffs or to everyone.  They are “advising” everyone that they should join FPC to be protected.

While I support their efforts, I find this more than a little disingenuous.

Update was issued Friday

Per the Fifth Circuit’s Order:

“This clarification is granted essentially for the reasons concisely set forth in the May 25, 2023, Plaintiffs-Appellants’ Reply to Their Opposed Motion for Clarification of Injunction Pending Appeal. . . Plaintiffs merely request clarification on whether their reading of the term ʻPlaintiffs’ to include the customers and members whose interests Plaintiffs Maxim Defense and Firearms Policy Coalition (ʻFPC’) have represented since day one of this litigation is correct.’ That reading is correct. Also as requested, the term “Plaintiffs in this case” includes the individual plaintiffs’ resident family members.”

“We’re incredibly excited to report that the Fifth Circuit has clarified that our injunction covers FPC’s members and Maxim Defense’s customers, as we have always argued for,” said Cody J. Wisniewski, Senior Attorney for Constitutional Litigation. “This relief will offer protection while we continue to fight against ATF’s overreach.”

Now the question is

Am I also covered if joining the FPC today, before the registration deadline but after the case?

Are all of a person's pistols covered or only their Maximum Defense braced pistols?

GOA and those employed by the state of Texas.

From GOA’s press release:

Erich Pratt, GOA’s Senior Vice President, issued the following statement:

“This assault on millions of Americans was just the latest example of President Biden trying to weaponize the DOJ against law-abiding gun owners, and we doubt it will be the last. We are incredibly grateful to Judge Tipton for hearing the pleas of our members who were facing serious prosecution simply for owning a piece of plastic – all because of an arbitrary reclassification by the ATF. GOA and our millions of members nationwide will continue to fight back against this rogue anti-gun administration at every turn in defense of our rights.”

Sam Paredes, on behalf of the board for GOF, added:

“While Congress was slow to act on this wide-reaching rule, GOF stepped in to defend the millions of Americans facing legal jeopardy. We are proud to have helped partially halt this rule, and hope it sends a message to anti-gunners hellbent on continuing the assault on the Second Amendment.”
