California's ban on assault weapons overturned by federal judge

The biggest problem is ahead..... the 9th Circuit court of appeals in San Francisco is about the most liberal in the land. In the past they have shown that the Law doesn't mean much to them.

Yep...then it heads upward...could be interesting!

 

Let hope things go well not only for the folks in California, but for the rest of the country as well.

The fact that it has occurred at all is encouraging.  The antis have never tried to achieve their goal in one step, preferring to chip away at the Second Amendment incrementally.  Supporters of the Second Amendment may have to use the same tactics.

Maybe so, but the timing could not be better for a trip to the Supreme Court with the 6-3 mix.  Also the court could pick it up on it own accord.  The 9th is the most overturned court in US.

“California may certainly conceive of a policy that a modern rifle is dangerous in the hands of a criminal, and that therefore it is good public policy to keep modern rifles out of the hands of every citizen. The Second Amendment stands as a shield from government imposition of that policy.”

Between this and the California legislature failing to pass new restrictive bills this last week, the citizens of the state had a pretty good week!!!

The best part is, this ruling will most likely be sent up the court system.

If the 9th circuit gets it and over turns it, it will go even higher up the system.

It could very well may be heard by the supreme court or sent back down to a lower court to fix any unconstitutional language.

I just want to hear one of the SCOTUS Justices ask "Please define exactly what an 'Assault Rifle' is"...would love to hear the response.

Now instead of rifle, use the word automobile or pickup and see how well that first statement actually works.

I love the second statement as it clarifies EXACTLY the reason for the amendment.

The 9th is actually doing better now, after President Trump appointed several new judges there.  This past winter, a 3-judge panel struck down the CA ammunition over-the-counter purchase law.  It is now under appeal to the full Court by our beloved Gov. Nuisance.  That outcome will tell us whether or not Trump succeeded in cleaning up the Appeals Court mess here.
