Evidently, First Amendment rights are limited

Good grief.  :huh:

 

A New Jersey college student faces suspension for using a photo of President Trump as the background on a Zoom call.

 

Ya just can't make this stuff up.  :(

     Stockton University doctoral student Robert Dailyda, according to a letter from the Foundation for Individual Rights in Education (FIRE), is facing student-conduct charges of disruptive behavior; discrimination; harassment; hostile environment; harm; and bullying and cyberbullying.

     The charges stem from July 1, when Dailyda used a photo of Trump as his Zoom background, according to a letter sent by FIRE to the university. FIRE is demanding that the charges be withdrawn no later than Tuesday.

Constitutional guaranteed rights are restrictions on government interference, not on private entities. Just like SASS can moderate and delete posts here on the wire, a college can decide what activity they deem appropriate.

Unless the school's actions are "state action", often found where the school is closely linked to government by virtue of such things as funding, state curriculum requirements, state licensing requirements, etc.  I don't know if this would apply to this school on these facts, but it may.

Stockton University, NJ.  State affiliated, but not state owned.  The college I work for is a state college, but was granted a charter by the legislature years ago, making it a separate entity.  Therefore, they are able to pass policy that doesn't follow state law, such as no weapons on campus.

Ironically,  if the kid had used a picture of Che Guavara, Castro, Mussolini, Stalin, et al... the school would not have made an issue at all. Probably would have made him tenured faculty.
