An act to add Section 30313 to the Penal Code, relating to ammunition.
 

LEGISLATIVE COUNSEL'S DIGEST

 
AB 3071, as introduced, Mullin. Lead ammunition: shooting ranges.
Existing law requires the sale of ammunition to be conducted by or processed through a licensed ammunition vendor. Existing law also requires the use of nonlead ammunition when taking big game mammals, nongame birds, or nongame mammals within the California condor range. Existing law requires the Fish and Game Commission to maintain, by regulation, a public process to certify ammunition as nonlead ammunition and to establish and annually update a list of certified nonlead ammunition.
This bill would prohibit a sport shooting range or an indoor shooting range, as defined, from selling or giving away ammunition unless that ammunition is certified as nonlead ammunition by the commission. The bill would also prohibit patrons or employees of a sport shooting range or an indoor shooting range from firing ammunition unless it is nonlead certified and would require a sport shooting range and an indoor shooting range to post a specified sign to that effect.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1.

 The Legislature finds and declares all of the following:
(a) Fifty years of research has shown that the presence of lead in the environment poses an ongoing threat to the health of the general public, whether at the workplace, the home, or in recreational endeavors.
(b) The United States Environmental Protection Agency defines lead as toxic to both humans and animals. Lead can affect almost every organ and system in the human body, including the heart, bones, intestines, kidneys, and reproductive and nervous systems. It interferes with the development of the nervous system and is therefore particularly toxic to children, causing potentially permanent learning and behavior disorders.
(c) Lead is a potent neurotoxin, for which no safe exposure level exists for humans. The use of lead has been outlawed in and removed from paint, gasoline, children’s toys, and many other items to protect human health and wildlife.
(d) In order to limit wildlife exposure to lead ammunition, California banned the use of lead ammunition for hunting in AB 711 (Chapter 742 of the Statutes of 2013), which was fully implemented on July 1, 2019.
(e) Ammunition that does not contain lead is readily available. Studies have shown that nonlead ammunition performs as well as, or better than, lead ammunition.
(f) A shooting range, especially an indoor shooting range, is a location that is a high-risk area for exposure to toxic lead. There are multiple documented examples of employees, patrons, and people in adjoining properties being exposed to lead dust from shooting ranges.
(g) Lead is spread through the vapor when a gun is fired and by the dust that comes off the bullet when it is fired. While some ranges have filters and other devices to remediate the lead dust, containment of lead dust in shooting ranges varies considerably between facilities. The only means to ensure that there will not be exposure to those inside and outside of the range is to stop using lead ammunition.

SEC. 2.

 Section 30313 is added to the Penal Code, to read:

 

30313.
 (a) A sport shooting range or indoor shooting range, as defined in Section 3482.1 of the Civil Code, shall not sell or give away ammunition unless that ammunition is certified as nonlead ammunition pursuant to Section 3004.5 of the Fish and Game Code.
(b) Only nonlead ammunition may be fired by patrons or employees within a sport shooting range or indoor shooting range.
(c) A sport shooting range or indoor shooting range shall conspicuously display, in a place where it can be seen by employees and patrons, a notice that reads, “The use of lead ammunition is prohibited in this facility.”

Section 2, subsection (b) Only nonlead ammunition may be fired by patrons or employees within a sport shooting range or indoor shooting range.

 

Look for this to spread to other States quickly.

I keep hoping some moderate democrats (there must be some left) will snap out of it and stop voting crazy "progressives" into office.  But if that doesn't happen, there's not much conservatives, who are outnumbered about 3-2, can do about it.

These idiots act like we are bringing space ships full of lead in from outer space.  They have no idea that  all of the lead came originally from the earth.  

 

They do have a point about lead exposure hazards, but their remedy is like stopping people from eating to prevent cases of  Salmonella illness from food contamination.   

 

Hopefully the industry will respond with non-lead material that is workable.   Plastic bullets may not be too far in our future.

Lead is a "potent neurotoxin"? What are we dealing with here, VX? Mr. Mullin is... well, he's misinformed.

Lead is a toxic heavy metal that occurs in nature and we are ALL exposed to it naturally.

Some in trace amounts, some in much higher amounts. I am NOT making light of what lead poisoning can do, but as with all hazards, you mitigate the risks, take precautions and get on with life. This is nothing more than an infringement on shooters, plain and simple. It has nothing to do with public safety.

Indoor ranges are under close EPA scrutiny and filtration systems have been required for a while now. Try to open a new indoor range and see what you have to go through. I have two daughters that have shot with me regularly for years and, due to lead hazards, I will not let them reload. They can still enjoy our sport with some safety precautions in place and I am not worried about having three-eyed grandchildren. If you are worried about your lead level, have it tested; you may have to make some changes, but removing lead from your environment entirely is not realistic.

I'm hoping there's enough moderate Democrats that will come to their senses to stop the madness in believing there is unlimited money to tax and spend.  Their belief that disarming the public will make us safer makes the government more powerful and the residents victims of both the government and the criminals.

There are not enough moderate Democrats, and even if there were, they will never gain enough power to change the laws.  Maryland is in the same cesspit of liberal politics, constantly trying to gain the lead on California when it comes to enacting this kind of BS.

 

Note that it doesn't matter where the ammo comes from, store bought or home made, the RANGES are the ones that will feel the pinch if a patron violates the law.  They will shut down SASS in a heartbeat if push comes to shove.

 

Until a more conservative court is in place, one that constantly smacks down the stupid laws and lawmakers that enact them, they will continue.  There is too much dirty money flowing to make the Democrats stop.

Apologies to my California pards but this not an attack on you; it is the realization that the U.S. is slowly being destroyed from within.

 

Ever since the PRoK enacted the jungle primary system and made it legal for a third party to go door to door to collect absentee ballots; the state's election system has been corrupted. It is no longer a democratic republic but a state run by criminals using mob rule to justify their actions.

 

The sad, disturbing, and totally terrifying part is that the PRoK is far from alone.  Over 10 % of the U.S. is infected by a corrupt and rotten political system that makes a mockery of the Democratic Republic our forefathers envisioned. Washington, Oregon, Illinois, Hawaii, Massachusetts, Virginia to name but a few are infected with this disease to varying degrees.

 

Words cannot begin to describe the dispare I feel for the future of my country.

One has to ask if shooting range lead exposure has been lessened in recent years, with most general range shooters  now using jacketed bullets and many of us using polymer coated bullets.   That is probably a very fair argument to advance.   I am betting the Bill author knows nothing of coated bullets.  

 

California CAS and other shooters need to be meeting face to face with State Legislators in their Districts to try to head this off.  We at least need to try to get amendments added to allow jacketed, plated, and coated projectiles.   There are some 2A supportive   State Assemblyman and Senators out there.  Assemblyman Jim Patterson is an energetic one whom we can work with.
