Is that considered a C&R? or does it have to go though a FFL?

That appears to be  Smith & Wesson New Departure (Safety Hammerless "Lemon Squeezer") Second Model with pinned front sight.  Mfg'd from 1902-1909.  So it would have to go to an FFL 03 (C&R) or your local FFL 01, 02, 07 etc.

If I recall correctly a six-inch model of the older version was used for army testing in the late 1880s. It's a cool piece and looks to be in great shape. I just sold one that was slightly newer, but it looked as though it had gone through the army testing. The shop I sold it to turned around and sold it for almost the same price as this. Had it looked like this I would not have sold it.

Serial number is 1639xx.  Yes its safe for smokeless powder.  If I remember correctly it a 3rd gen.

If it's a Third Model, that would put it from 1909-1937, would definitely need to go to some kind of FFL.  There is overlap of serial numbers, second model from numbers 91,418 - 170,000... Third model numbers are 163,082 - 242,981

Second models had a pinned front sight and a T-shaped latch, third model had a forged front sight.  But, things weren't always "written in stone"  features overlapped as well as numbers.

Nice!  And would definitely make a nice pocket pistol side match gun.

BTT!
