Allegiance Posted June 5, 2015 Share Posted June 5, 2015 New Jersey: Assembly Committee Advances Bill That Contains Inadequate Due Process On Monday, the Assembly Law & Public Safety Committee passed Assembly Bill 4218, introduced by Assemblywoman Gabriela Mosquera (D-4), on a party-line 5-3 vote. Despite opposition and testimony against the bill from both NRA and NRAs state association, the Association of New Jersey Rifle and Pistol Clubs (ANJRPC), the misguided legislation moved forward. Although the bill is purported to enhance penalties for domestic abusers, it unfortunately goes much further by denying due process to individuals. It is important that due process exists to protect those who may be falsely accused, or accused of offenses which are non-violent. Testimony on the bill revealed serious constitutional issues related to spousal privilege and seizure of property without adequate due process. It also contains numerous pitfalls which have the potentialto ensnare innocent individuals, as we have seen repeatedly with New Jersey gun laws. A.4218 now advances to the Assembly floor, and it is expected to be heard soon.
