"Dear J&G Customer, J&G NEWS: LAWSUIT FILED TODAY AGAINST THE BATFE As many of you may have heard, the BATFE has sent an unprecedented “demand letter” to all the licensed firearms dealers in the four border states of Arizona, New Mexico, California, and Texas. This will require dealers to report to the BATFE the names and addresses and serial numbers of all purchases of more than one semi-automatic rifle, with a detachable magazine, over 22 caliber, within a 5 business day period. This new and extreme regulation goes into effect for all purchases that occur on or after August 14th, 2011. The BATFE has issued a new form 3310.12 that FFL dealers have to complete and return to the BATFE starting on this date and going forward. The BATFE and Department of Justice has made this demand on us and on you, with no Congressional authorization. Therefore today J&G Sales has filed suit in the Washington DC federal court challenging this illegitimate regulation. We are being assisted in this law suit by the NRA as well. We hope the outcome of our challenge will be a reversal of this unconstitutional regulation. Bodine Posted August 4, 2011 Share Posted August 4, 2011 In the mean-time, all the border states gun shops should invest in big rubber stamps with two letters on them (F & U), stamp and send all those forms back as required with the Second Amendment text in the information field until the suit is settled. The NRA Attorneys are paid by YOU, the member. J&G Attorneys are paid by YOU, when you buy something from them. Just IGNORE it, It is TOTALY Illegal !!! Let the BATF file the lawsuit, saying you have to comply, then in court they have to PROVE you have to comply, and they CAN NOT ! This is Exactly the same as, you driving down the road at 55 MPH, on a road that is posted at 55 MPH, A cop pulls you over, and says: "I'm giving you a speeding ticket". Even though this "regulation" is totally unsupported by any existing US code, willful failure to comply can get the FFL's license revoked. Until the federal court rules this reg illegal, FFLs will have to comply. In your example, the person cited for speeding would still have to go before a judge and have the judge rule the ticket illegal. I would have my license revoked and then have to sue the ATF to have it restored. J&G is doing a pre-emptive strike....and God love 'em for it....to prevent the regulation frm even being enforced. It does not matter whether the NRA sues them immediately or waits until they try to enforce it. In either scenario, the case will end up in court and there will be costs to the taxpayer and the customers. Just because a law or instruction is illegal does not allow the subject (I refuse to use the word citizen in such a case) the right to ignore it. Even if the policeman is acting illegally, you will still go to jail, you will still be punished, and you will have to spend copious amounts of time and money proving you were innocent and then seeking remedies in a civil suit. Please reference Barnes v. State of Indiana. The, 'word' is, "...If you don't give the bully your desert, you will get a black eye..." So everyone gives the 'bully' their desert. Then one day, someone that the 'bully' tries to take their desert from, gives the 'bully' a black eye. The 'Bully' stops taking peoples deserts. The point is, this, "Made UP, rule" by the BATF, is Just That, MADE UP ! It is NOT a Statute, it is NOT a Law ! And they, can NOT do what they want. Can they, (BATF) say: "You have to put a "B" instead of, "Bolt Action", Or visa versa, in the bound book, sure, That is IN their Statues. (and those who have a FFL will testify they have been told, BOTH. It is suppose to be this way, or that way, depending on what their examining agent says). But can they, Make Something Up, Out Of the BLUE, NO !!!!!. I have had a FFL for 20 + years, I have worked on other gun shops for 20 + years. I have Dealt with the big bully for a number of years. And I don't have the time to tell you of how many times, where I have proved to a, Town, Township, County, State, that a "Made Up" 'rule', is NOT VALID ! When a 'examining' agent comes in to a FFL business, and says: "Oh No, you have to do that, like this", I say: "OK, send me a letter, on the BATF letterhead, with your signature, and your ID number, stating what you want me to do, Then I will do it". GUESS WHAT FOLKS, the Letter, NEVER COMES !!!!!!! SO, If I had a FFL in one of the States, where the BATF, MADE UP, a new ruling, which is, At This Current Time totally ILLEGAL, I would, with Out A Doubt, Ignore it, and I would campaign that Others in those states, did the same. Then IF, and not when, but IF, the big bully, decided to pursue beyond what they call, "A Willful Volition" . I would go to court, with 100 + other dealers. And PROVE them WRONG. Now, that is MY opinion, you can agree or disagree. It is YOUR choice, to give the bully your desert, biased on a threat, or stand up to the bully. (((Or perhaps, you can bring two, HIDE one, and GIVE one to the Bully))) Your Choice, Stand up, and be the Ram on the Mountain, or be the sheep in the herd, waiting to be turned into Haggis. You can certainly disagree, but enough of the snide remarks. Probably no one here remembers a fellow by the name of Bill Bridgwater, this Attitude is in memory of him! Anybody know the WHOLE story about, 'Ruby Ridge" ? Remember, a Lawyer, makes MONEY, whether they, Win or Loose. Value your freedom ? Ya wanna Talk, or DO ? How many of you have written a letter, to: The President, Your Federal Representatives, Your State Representatives, Your County Commissioners, Your Township Supervisors Your Town Council. A POLITE letter, stating your views, Regardless if you, or they, are a, Republican, Democrat, or Independent. A POLITE, letter stating YOUR views, NOT a 'Can' letter, NOT a 'E-Mail" NOT a 'Phone call" But a Individual LETTER. A Individual Letter is HUGE ! In the opinion of a individual Politician. Or do you believe a Man, who in the late 1930 said to the effect; 'your One Vote does Not Count, it Only Counts if you are a Member of the, 'Party' Can you guess which, 'party' that was ?
