Based on the early references, I tend to believe it has to do with baseball and whether the teams would be able to play the whole 9 innings at the yard before darkness or some other event caused the game to be called. Same case. Today California Superintendent of Public Education Tom Torlakson announced he would ask the CA DOJ to appeal the ruling after Judge Treu reaffirmed his ruling on Thursday. Judge Treu didn't rule that tenure was unconstitutional. He ruled that specific pieces of legislation that implemented it needed rewriting. BTW, in California tenure is just permanent employee status, where you can only be fired for cause, as opposed to probationary status, where you can be fired at will.
