... we will MODIFY the District Court’s order so that it deems the Assault Firearm Provisions unconstitutional with respect to the full class of semi-automatic rifles. We will AFFIRM that part of the order as modified.

The LCM Provisions also violate the Second Amendment, so we will REVERSE the District Court’s order with respect to those. Because the LCM Provisions violate the Second Amendment, we need not address the Takings Clause challenge.

We will REMAND these matters to the District Court for further proceedings, including for resolution of the Second Amendment challenge to the other models and types of firearms covered by the Assault Firearm Provisions.

Friday Finds - Armed with Reason

“Tennessee expanded its self-defense laws via House Bill 1802 (Public Chapter 1100), which took effect on July 1, 2026. The update allows residents to use deadly force to protect private property during four specific crimes: arson, burglary, robbery, and aggravated cruelty to animals.

Conditions to Use Deadly Force

Previously, deadly force was generally prohibited solely for property protection. The updated law lifts this restriction under strict conditions. To be justified, you must meet the following criteria: 

Location: 

You are in a place where you lawfully reside or have a right to be.

Reasonable Belief: You reasonably believe deadly force is immediately necessary to stop one of the four covered crimes.

No Alternative: 

You must reasonably believe the property cannot be protected by other means, and using lesser force would put you or others at risk of death, serious injury, or sexual abuse.

Lawful Behavior: 

You cannot be engaged in a felony or Class A misdemeanor at the time. 

Understanding Stand Your Ground

Tennessee’s traditional "Stand Your Ground" laws give individuals the right to use deadly force without a duty to retreat if they reasonably believe they face an imminent threat of death or serious bodily harm. This self-defense law applies to a person's safety, whereas the new update explicitly extends defensive lethal force to specific crimes against property. 
 

Citizen's Arrests and Devices

The legislation also clarifies that a private citizen making a citizen's arrest may use or threaten deadly force to the extent authorized by these new property laws. Furthermore, it updates the language surrounding mechanical or protective devices (like booby traps), stating that they cannot be designed to cause a substantial probability of death or extreme physical pain.”
